Online Services Portal - Terms and Conditions

Queensland Courts provides online services through the Online Services Portal, which include, but are not limited to:

  • the ability to electronically lodge, access and receive court documents; and
  • the ability to interact with Queensland Courts in relation to matters to which you are a party or a legal representative of a party.

Information lodged electronically or uploaded to the Online Services Portal will be stored and used in a digital court file.

Before you use the Online Services Portal you must carefully read these terms and conditions.

If you do not agree to the terms and conditions, then you must not use, or continue to use, the Online Services Portal.

1. Terms and Conditions of Use

  1. 1.1. In these terms and conditions:
    1. 1.1.1 "You" and "Your" means the user of the Online Services Portal;
    2. 1.1.2 "We", "Our" and "Us" means Queensland Courts.
  2. 1.2. The Online Services Portal is a system for the electronic lodgement of, and access to, documents in relation to certain proceedings brought in the Supreme, District or Magistrate Courts of Queensland.
  3. 1.3. To use and access the Online Services Portal, You must agree to and comply with the below conditions.

2. Access to Information

  1. 2.1. The information available through the Online Services Portal is provided as information only. It is not a substitute for, nor should it be considered or relied upon as independent legal advice. You must carefully consider and evaluate the information for its accuracy, relevance, completeness and suitability for the intended use or purpose.
  2. 2.2 To the maximum extent permitted by law:
    1. 2.2.1. We make no statements, representations or warranties about the accuracy, completeness or suitability for any specific purpose of any information contained in the Online Services Portal.
    2. 2.2.2. We make no warranties that the Online Services Portal or information in the Online Services Portal is free of defects or infection by computer viruses or other contamination.

3. User Obligations

  1. 3.1. By using the Online Services Portal, You accept responsibility for:
    1. 3.1.1. maintaining the confidentiality of any account information including usernames, logins, passwords, security questions and answers that You use to access the Online Services Portal or any functionality within the Online Services Portal.
    2. 3.1.2. all activities that occur using Your accounts, usernames, logins, passwords, security questions and answers including those which may result from your negligence, carelessness, misconduct, or failure to use or maintain appropriate security measures.
    3. 3.1.3. logging out of Your account and any areas in the Online Services Portal containing sensitive information.
    4. 3.1.4. promptly reporting, in accordance with these terms and conditions, any suspicious or unauthorised activity in relation to Your account/s, username/s, login/s, password/s, or security questions and answers as soon as You become aware of it.
    5. 3.1.5. allowing "cookies", which are necessary for the proper function of the Online Services Portal. There are certain functions within the system that require the browser to allow the creation of cookies on Your computer. Cookies are not used to collect personal information.
    6. 3.1.6. all activities that occur as a result of Your use of the Online Services Portal.
  2. 3.2. You must at all times comply with relevant laws in relation to the access, use, storage, disclosure of and otherwise dealing with any information accessed via the Online Services Portal.
  3. 3.3. Any suspicious or unauthorised activity in relation to Your account/s, username/s, login/s, password/s, or security questions and answers must be reported as soon as You become aware of the suspicious or unauthorised activity by sending notification to CASE-Apps-Support@justice.qld.gov.au.
  4. 3.4. Users who act as administrators of system usage for their firm or agency must maintain up-to-date access for authorised users within their firm or agency.
  5. 3.5. By using the Online Services Portal, You accept that You are responsible for ensuring compliance with all relevant legislation, regulations, rules, practice directions, and approvals pertaining to electronically filed and signed documents.
  6. 3.6. You are responsible for ensuring that you are aware of any correspondence, documentation, orders, requests or other sent or issued by Us through the Online Services Portal.
  7. 3.7. We may, at any time, remove any authorisation for you to continue to use the Online Services Portal, with or without notice to you, if you do not comply with these terms and conditions.

4. Availability

  1. 4.1. We endeavour to provide a reliable system, however, We make no warranty that the Online Services Portal, nor any particular functionality within the Online Services Portal, will be available at all times or at any particular time.
  2. 4.2. You acknowledge that the Online Services Portal may become unavailable at any time, including due to:
    1. 4.2.1. computer, web server or software malfunction or network congestion;
    2. 4.2.2. the failure of the communication network provided by the Internet Service Provider for You or Us;
    3. 4.2.3. ancillary equipment failures;
    4. 4.2.4. the need to carry out scheduled maintenance;
    5. 4.2.5. a serious threat posed to the system or any part of the system supporting the Online Services Portal;
    6. 4.2.6. other circumstances beyond Our reasonable control.
  3. 4.3. If for any reason the Online Services Portal is unavailable, You accept that it is Your responsibility to use other means to undertake urgent or time sensitive transactions. We accept no liability in relation to the temporary or permanent unavailability of the Online Services Portal.
  4. 4.4. We may in Our sole discretion cease providing You with access to the Online Services Portal, including by suspending or terminating Your access to the Online Services Portal, without any obligation by Us to give notice or provide a reason.
  5. 4.5. We have no control over the data transmission speed where the internet is used for access.

5. Disclaimer of Liability

  1. 5.1. We disclaim and exclude, to the maximum extent permissible by law, any terms and conditions implied by law relating to any loss or damage that may be suffered by You as a result of You using the Online Services Portal.
  2. 5.2. Without limiting the above paragraph, We disclaim and exclude, to the maximum extent permissible by law, all warranties, express or implied, including without limitation any warranty as to the accuracy, quality, context, completeness, availability, reliability or suitability for any purpose, of any information contained in, relied upon, or accessed through the Online Services Portal.
  3. 5.3. To the fullest extent permitted by law, We disclaim all responsibility and all liability (including, without limitation, liability in negligence) for all expenses, losses, damages and costs You may incur as a result of using the Online Services Portal or relying on the information in the Online Services Portal, for any reason.
  4. 5.4. The disclaimers in these terms and conditions apply equally to disclaim the State of Queensland (acting through the Department of Justice) from any responsibility or liability arising.

6. Collection of personal information

  1. 6.1. We collect Your personal information when You register as a user of the Online Services Portal and when you make use of the services provided within the portal. The Collection Notice, Department of Justice Privacy Policy, and Queensland Courts Privacy page explain in detail how We manage Your personal information.

7. Intellectual Property

  1. 7.1. You acknowledge that You do not acquire any property rights, including intellectual property rights, in information provided via the Online Services Portal.
  2. 7.2. You may use the information provided via the Online Services Portal for the purposes of court proceedings in which You are involved as a party or legal representative on the record for a matter.
  3. 7.3. You are not granted any right to use, reproduce or adapt the information contained within, or develop derivative products from, the Online Services Portal, or to use it for any other purpose beyond the court proceedings in which You are involved as a party or legal representative on the record for a matter.

8. Alteration of Terms and Conditions

  1. 8.1. We may, at any time, and at Our absolute discretion, vary these Terms and Conditions and any documents referred to in item 6.1 by making available a varied copy of the Terms and Conditions or associated documents online.
  2. 8.2. Your continued use of the Online Services Portal following a change in the Terms and Conditions is an implied acceptance of the updated Terms and Conditions.
  3. 8.3. It is Your responsibility to ensure You are aware of the Terms and Conditions that apply each time You access and use the Online Services Portal.

9. Governing Law

  1. 9.1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws and courts of the State of Queensland, and you agree to submit to the exclusive jurisdiction of the Courts of Queensland.

10. Severability

  1. 10.1. If any of these Terms and Conditions are held to be void, invalid, unenforceable or illegal for any reason, that term will be severed from these Terms and Conditions to the extent required, without affecting the enforceability of the remaining terms.
